Affiliate Program Terms and Conditions

The fine print As an authorized affiliate (“affiliate”) of divimode.com (“we”, “us”), you agree to abide by the terms and conditions contained in this Agreement. Please read the entire Agreement carefully before registering and signing up as an affiliate. By signing up as an affiliate, you are agreeing to accept this Affiliate Program Agreement and its terms and conditions

This Affiliate Program Agreement (“Agreement”) is subject to change at any time, without prior notice. You are responsible for reviewing this Agreement on a regular basis.

1. Approval of the Application

TLDR “It’s our call who can participate.”

The fine print We reserve the right to approve or reject any Affiliate Program Application in our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application.

2. Commissions

TLDR We help you make money if you help us make money.”

The fine print Commissions will be paid automatically at the end of each calendar month. For an Affiliate to receive a commission, the referred customer must remain active for a minimum of 37 days.

You cannot refer yourself, and you will not receive a commission on your own purchases. Only successfully completed transactions generate a commission. 

When a customer asks for a refund within the guaranteed 14-day-money-back period, his customer account is cancelled (not active anymore) and not subject to an affiliate commission. The same applies to payments that are charged back by a credit card company.

Payments are sent out automatically at the end of each calendar month to Affiliates with a balance of $20.00 and above. No payments will be due or payable until an Affiliate has earned at least $20.00 hereunder. Payments are only made through PayPal. Therefore, you must have a valid PayPal email address assigned to your account to receive any payment. Any commission that is not paid out in a specific month carries over to the next month.

2. Affiliate Tracking

TLDR We track visitors for 14 days. The first/oldest referrer gets lifetime commissions for all sales of the customer.”

The fine print All sales are tracked using visitor IP and/or cookies. While this is the best method available, it is not perfect. We can only guarantee that sales will be tracked if the user’s IP does not change or their cookies are not cleared.

The first affiliate to refer a visitor gets credit for the sale. Multiple affiliates will not be paid for the same sale. Affiliates agree that in the event of a dispute regarding credit or payment, the sole determination of divimode.com shall be final and binding. If a payment is refunded, then the commission for this payment will be removed from your account.

Only intentional clicks are allowed in the system. Forcing visitors to click a link, or using fake tracking pixels (also known as “cookie stuffing”), or any other means to register unsuspecting visitors in the system is strictly prohibited. Accounts using such methods will be terminated without warning and all revenues will be forfeited. This includes, but is not limited to, the use of: Auto-Hit or Auto-Surf programs, displaying affiliate tracking URL within an iframe or image src, automatic pop-ups or automatic redirects to affiliate URL’s without action by the visitor, or any other method meant to automatically track a visitor in the affiliate system without an intentional click from an interested buyer. If we believe that you have fraudulently added registrations by non-approved methods (as solely determined by us), you agree to forfeit the payout for all such fraudulent leads.

Visitors referred by an Affiliate are tracked for a maximum of 14 days. Visitors who are referred and make a purchase later than 14 days after clicking an Affiliate’s link will not be tracked, and a sale will not be awarded or compensated.

The first affiliate who refers a customer who completes a purchase will also be awarded commissions on that customer’s future purchases. Customers who purchase a product, service or subscription without an affiliate referral will not generate commissions on any subsequent subscription renewal payment.

3. Termination

TLDR “Be honest and professional if you want to stick around.”

The fine print Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

  • Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
  • Spamming (mass email, mass newsgroup posting, etc.).
  • Advertising on sites containing or promoting illegal activities.
  • Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.
  • Violation of intellectual property rights.
  • Offering rebates, coupons, or other form of promised kick-backs from your affiliate commission as an incentive.
  • Self referrals, fraudulent transactions, suspected Affiliate fraud.

In addition to the above, we reserve the right to terminate any Affiliate account at any time, for any violations of this Agreement or no reason.

4. Affiliate Links

TLDR “Refer us in any way you see fit and use the Affiliate Links we provide.”

The fine print You may use graphic and text links both on your website and within in your email messages. You may also advertise any content of divimode.com in online and offline classified ads, magazines, and newspapers. While linking to our content is encouraged, it is not allowed to duplicate our content on your own online or offline platforms without our explicit consent.

To connect a sale to an Affiliate, you need to use a special Affiliate Link, also known as referral link, or tracking code (“Code”). This Code is provided by divimode.com and may not be modified. If you alter, remove or disable any part of the Code, the Affiliate Tracking can fail resulting in lost commissions. In the event of a discrepancy in reporting, the tracking statistics and reports of divimode.com shall control.

You may use the graphics and text provided by us, or you may create your own as long as they are deemed appropriate according to the conditions and not in violation as outlined in Condition 3 above.

5. Pay Per Click (PPC) Policy

TLDR “Don’t steal our PPC traffic.”

The fine print PPC bidding is NOT allowed without prior written permission.

6. Liability

TLDR “Problems are not expected but may happen.”

The fine print We cannot be held liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Program and/or to our website(s).

We do not make any expressed or implied warranties with respect to the Program and/or the memberships or products sold on divimode.com. We make no claim that the operation of the Program and/or our website(s) will be error-free and we will not be liable for any interruptions or errors.

Terms of the Agreement

TLDR “Play by the rules while you’re on board.”

The fine print The term of this Agreement begins upon your acceptance in the Program and will end when your Affiliate account is terminated.

The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement are unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Program will constitute your acceptance of any change.

Indemnification

TLDR “Keep divimode.com out of trouble.”

The fine print Affiliates shall indemnify divimode.com and hold harmless and defend divimode.com from any claim, damage, lawsuit, action, complaint, or other costs arising out of any breach of the Affiliate’s warranties set forth herein. The Affiliate shall also indemnify, defend and hold harmless divimode.com for any damage, loss or other cost arising out of the use or misuse by Affiliate of the Promotional Materials.
